Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "your", or "User") and Juan Ignacio Molfino ("we", "us", "our", or the "Company"), which operates Pic Your AI (the "Service"), available at https://picyourai.com/. Please read them carefully. By creating an account, accepting these Terms at sign-up, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

Pic Your AI is an AI-powered service that lets you generate professional-style headshots and edited images. To do this, you upload photographs of yourself, and we use a third-party AI provider to train a personalized image model (a "Model") based on those photographs. You can then use credits to generate new images and to make quick edits.

The Service relies on third-party providers for model training, image generation, storage, payments, and email. By using the Service you acknowledge that your content is processed by these providers as described in our Privacy Policy.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent and warrant that you meet this requirement. The Service is not directed to children, and we do not knowingly collect data from minors. You may not upload photographs of any person under 18 years of age.

3. Accounts

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date. We may suspend or terminate accounts that violate these Terms.

4. Your Content and Your Responsibilities

"User Content" means the photographs and any other materials you upload to the Service.

By uploading User Content, you represent and warrant that:

  • The photographs are of yourself, or you have obtained the explicit, informed consent of every identifiable person depicted to upload their image and to have an AI model trained on it.
  • You own or have all necessary rights to the photographs and grant the permissions described below.
  • No photograph depicts a minor under 18.
  • The photographs and your use of the Service do not violate any law or third-party right (including privacy, publicity, and intellectual property rights).

Biometric data notice. Photographs of faces, and models trained on them, may constitute biometric or facial data under certain laws. You explicitly consent to this processing at the point of upload. You can withdraw consent and delete your data at any time as described in Section 11 and in our Privacy Policy.

License to operate the Service. You retain ownership of your User Content. You grant us a limited, non-exclusive, worldwide license to host, store, process, transmit to our sub-processors, and use your User Content solely to provide and operate the Service for you (including training your Model and generating your images). We do not use your User Content to train general-purpose models for other users.

5. Acceptable Use

You agree not to use the Service to:

  • Upload images of other people without their explicit consent, or images of minors.
  • Create content that is unlawful, defamatory, harassing, hateful, sexually explicit, or that impersonates another person for deceptive purposes.
  • Generate content intended to deceive, defraud, or mislead (including deepfakes used to harm or impersonate).
  • Infringe intellectual property or privacy rights.
  • Attempt to reverse engineer, scrape, overload, or circumvent the Service, its rate limits, or its security.
  • Resell or redistribute the Service without our written permission.

We may remove content and suspend or terminate accounts that violate this section.

6. Credits, Subscriptions, and Billing

The Service uses a credit system:

  • Gold credits are used to train Models.
  • Blue credits are used to generate and edit images.

Subscriptions. Subscription plans grant a monthly allowance of credits. Subscription credits do not roll over: at each renewal, your subscription credit balance is reset to the plan's allowance. Unused subscription credits are forfeited at the end of each billing period.

Credit packs. Credits purchased separately as one-time packs do not expire and remain available until used or until your account is deleted.

Payments. Payments are processed by Stripe. You authorize us (via Stripe) to charge your payment method for your purchases and for recurring subscription fees until you cancel. Prices are shown at checkout and may change with notice.

Cancellation. You may cancel your subscription at any time. Cancellation stops future renewals; you will not be charged again, and you retain access and any remaining subscription credits until the end of the current paid period. Subscription credits are not carried beyond that period. See our Refund Policy for details.

7. Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. In summary: if a generation or training attempt fails on our side, the credits used for that attempt are returned to your balance. Subscription fees already charged are not refunded upon cancellation. Consumable credits are otherwise non-refundable.

8. Intellectual Property

Your outputs. As between you and us, you own the images you generate from your own User Content, subject to your compliance with these Terms and applicable law. Note that the legal status of AI-generated content varies by jurisdiction and we make no representation that AI-generated images are protectable by copyright.

Our platform. We and our licensors own all rights in the Service itself, including its software, design, and trademarks. These Terms do not grant you any rights in our platform except the limited right to use it.

9. AI-Generated Content Disclaimer

The Service uses artificial intelligence, which can produce inaccurate, unexpected, or unflattering results. Outputs may not perfectly resemble you and may contain artifacts. We do not guarantee any particular result, likeness, or quality. You are responsible for how you use generated images.

10. Third-Party Services

The Service depends on third parties including, among others, Fal, OpenAI (via Fal), Google (Gemini), Stripe, Supabase, Cloudflare, Resend, Upstash, and Inngest. Your use of the Service is also subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers.

11. Data Deletion and Termination

You may delete your account and associated data at any time using the in-app "Delete my data" feature. This permanently removes your profile, trained Models, and generated images, and unlinks your transaction records (which we retain in anonymized form for accounting and legal compliance). We may suspend or terminate your access if you breach these Terms or to comply with law. Upon termination, your right to use the Service ends.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right — including claims by any person depicted in your uploaded photographs who did not consent.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or in-app) and update the "Last updated" date. Continued use after changes take effect constitutes acceptance. Where required by law, we will ask you to re-accept.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. The exclusive venue for disputes will be the state or federal courts located in United States, United States, and you consent to their jurisdiction, except where applicable consumer-protection law grants you the right to bring proceedings in your country of residence.
